Employment-based categories are as follows: EB-1 remains current for all countries; EB-2 is current for all countries, except for India (Sept. 1, 2004)* and China (Aug. 8, 2008); EB-3 is at Jan. 1, 2009 for all countries, except for India (Jan. 22, 2003) and Philippines (Oct. 1, 2006); EB-3 other workers is at Jan. 1, 2009 for all countries, except India (Jan. 22, 2003), China (March 22, 2004), and Philippines (Oct. 1, 2006); EB-4, religious workers, EB-5 targeted employment areas and regional centers, and EB-5 Pilot Programs are all current. Family based petitions are backlogged, with the most recent date at Oct. 8, 2011 for F2A (spouses and children under 21 of lawful permanent residents) and the longest queue for F4 Philippines (brothers and sisters of U.S. Citizens) of Dec. 15, 1989.

*According to the Department of State bulletin EB-2 priority dates for India may advance in August or September.

“India: At this time it appears that the availability of “otherwise unused” Employment Second preference numbers will allow for movement of this cut-off date in August and/or September. It is expected that such movement will generate heavy new applicant demand, primarily by those who are upgrading their status from the Employment Third preference category. A sustained level of heavy demand could impact the cut-off date at some point during fiscal year 2014. “
