Employment-based categories are as follows: EB-1 remains current for all countries; EB-2 is current for all countries, except India (Jan. 1, 2008)* and China (Aug. 8, 2008); EB-3 is at Jan. 1, 2009 for all countries, except India (Jan. 22, 2003) and Philippines (Oct. 22, 2006); EB-3 other workers is at Jan. 1, 2009 for all countries, except India (Jan. 22, 2003), China (March 22, 2004), and Philippines (Oct. 22, 2006); EB-4, religious workers, EB-5 targeted employment areas and regional centers, and EB-5 Pilot Programs are all current. Most family based petitions are backlogged, except F2A (spouses and children under 21 of lawful permanent residents)* which is current for all countries. The longest queue is for F4 Philippines (brothers and sisters of U.S. Citizens) of Jan. 8, 1990.
*According to the Department of State bulletin EB-2 priority dates for India and Family F2A advanced the month of August.
“These changes for the Family F2A, and India Employment Second preference categories reflect actions which have been taken based on current applicant demand patterns. Readers should expect that some type of “corrective” action will be required at some point during FY-2014 in an effort to maintain number use within the applicable annual limits. Such action would involve the establishment and retrogression of such cut-off dates, and could occur at any time..”
